Kursspecifika förkunskaper

In order to be eligible for this course, applicants must be generally eligible to attend elective courses at Chalmers in their fourth year (fourth grade).

Syfte

The aim of the course is to provide students with a fundamental understanding of the critical role that intellectual property rights (patents, copyrights, trademark rights etc.) play in commercial activities within the knowledge economy. These legal constructions will be understood in the context of the entrepreneur and the strategic manager of corporate activities. The course puts particular emphasis on how companies can use these strategically important assets to achieve a competitive advantage.

Lärandemål (efter fullgjord kurs ska studenten kunna)

1) define and interpret the concept of intellectual property, and be able to interrelate to the various legal constructions surrounding intellectual property,


2) explain the concepts and scopes of: copyright and copyright protection; trademarks and trademark protection; patents and patent protection; design rights and design protection, and apply these concepts in a commercial context,


3) apply the concepts of intellectual property to business constructions in order to formulate and successfully express intellectual property-based strategies based on choosing and using appropriate intellectual property protection; making strategic choices as to how and when to obtain protection, enforce protection and evaluate the protection of others (and act accordingly); and on evaluating and creating licensing strategies and other value creation mechanisms to leverage the value in intellectual property, and


4) functionally and creatively utilize their knowledge of legal constructions in combination with their awareness of knowledge-based business development to perform an intellectual asset or property analysis of an existing or fictional company and to present the results of this analysis.

Innehåll

The course is divided into three sections which is read partly in parallel:
The first section gives a general overview of intellectual property rights (IPRs), the rights to employees inventions and the handling of IPR conflicts. The section emphasizes explaining how a management-oriented view differs from that of a judge, lawyer or patent agent.

The second section deals with strategies for choosing IPR protection and with IPR relationships with competitors and partners. Areas included are strategies for patent filing, copyright protection in IT and protection of brands and designs. The section also deals with the usage of patent documentation for monitoring of technological, competitive and market developments.

The third section focuses on the commercialization of intellectual property rights. Issues such as licensing and the commercialization of innovations are covered.

Organisation

The course consists of a lecture series, a series of exercises and a case. Attendance at the exercises is mandatory.

The students are graded on their performances in the simulations individually, in the form of a written exam, case and active participation at the exercises.
